Desert Hot Springs Fence & Deck provides residential and commercial deck construction, fence installation, and related outdoor structure services in the Coachella Valley and surrounding areas of California. The specific scope of work for any project is defined in a written proposal or contract signed by both parties. Nothing on this website constitutes a binding offer or guarantee of service availability, pricing, or scheduling.
All estimates provided by the Company, whether verbally or in writing, are based on information available at the time the estimate is prepared. A written estimate is valid for 30 days from the date it is issued unless otherwise stated.
Final pricing is confirmed in a signed written contract before work begins. Estimates may be revised if site conditions differ materially from what was observed during the initial estimate visit, if the scope of work changes at the customer's request, or if unforeseen conditions are discovered during construction (such as deteriorated framing, unsuitable soil, or buried obstructions). The Company will notify the customer of any scope or cost changes before proceeding with additional work.
Project start dates are estimates and are subject to permit approval timelines, material availability, weather conditions, and scheduling constraints. The Company will make reasonable efforts to begin and complete work within the timeframes communicated to the customer.
If you need to reschedule or cancel a project, please notify us as soon as possible by calling (760) 993-6310 or emailing projects@deserthotspringsfenceanddeck.com. Cancellation terms, including any deposit refund conditions, are specified in your signed contract.
The Company reserves the right to reschedule work due to unsafe weather conditions, supply chain delays, or other circumstances beyond our reasonable control, without liability to the customer.
Payment terms are outlined in the written contract for each project. Projects typically require a deposit before work begins, with the remaining balance due upon completion or at milestones specified in the contract. The Company accepts payment by the methods listed in your written contract.
If payment is not received when due, the Company may pause or suspend work until payment is received. Unpaid balances may accrue interest at the maximum rate permitted by California law. The customer is responsible for any reasonable collection costs, including attorney fees, incurred in collecting overdue payments.
For projects requiring building permits, the Company will apply for and obtain required permits on the customer's behalf as part of the agreed scope of work. Permit fees are typically included in the project estimate or disclosed separately. The customer is responsible for ensuring that the project complies with any homeowners association (HOA) rules or deed restrictions applicable to their property. The Company will cooperate with HOA approval processes but is not responsible for delays or modifications required by an HOA.
The Company warrants that workmanship will meet applicable building codes and will be performed in a professional manner. Specific warranty terms for labor and materials are outlined in the written contract for each project.
Manufacturer warranties on materials (such as composite decking boards, railing systems, or fence products) are passed through to the customer and are governed by the respective manufacturer's warranty terms. The Company makes no representations beyond those provided by manufacturers.
This Site and any information on it are provided "as is" without warranty of any kind. We do not warrant that the Site will be error-free or uninterrupted.
To the fullest extent permitted by California law, the Company's total liability to you for any claim arising out of or related to our services or this Site shall not exceed the total amount you paid to the Company for the specific project giving rise to the claim.
In no event shall the Company be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits or loss of use, even if the Company has been advised of the possibility of such damages. This limitation applies regardless of the legal theory on which the claim is based, including contract, tort, or strict liability.

If informal resolution is not possible, disputes shall be submitted to binding arbitration in Desert Hot Springs, CA, in accordance with the rules of the American Arbitration Association, unless the dispute qualifies for California small claims court. Class action lawsuits and class-wide arbitration are not permitted under these terms.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action not subject to arbitration under Section 9 shall be brought in the state or federal courts located in Riverside County, California.
